When you took it in for the battery change were you given a receipt and if so what was written on it I assume you have consumer laws why not use them to get this matter sorted I would have thought that shop at time would note any obvious problems with it and not being able to move the hands with the crown should have ben spotted

Thanks for clarify question.
The staff in the store spent a good 15 minutes to study my watch under special glass, and noted the below conditions in her report. She also pulled the dial to turn the needles and checked the watch carefully in great details.
With my normal eyes, I could hardly see of any scratches, but On my receipt, I found the following notes:
  • Band scratch
  • Case scratch
  • Dial worn
  • Glass worn,
However, there was nothing about the crown or dial got jammed
You should then win the case easily as it was fine when you took it in use your countries civil system and sue them If this wasin the uk it does not matter who blames who
